Graber avers that the state legislature is to blame for allowing those who operate in the gray zone to flourish. "Legislators need to tighten the gray zone, but there are a lot of politicians who operate in it," he says. "I want to change it, but the legislature refuses to do that. Why? Because they like it."

And the flourishing gray zone, says Graber, is undermining trust of all levels of government -- a fact that Ilene Michelson's legal arguments can never change.
